Buyer-Agent Agreements in Michigan

Michigan has NOT enacted its own state statute codifying buyer-agent representation agreement requirements in the style of Texas's SB 1968 (effective Jan. 1, 2026) or California's AB 2992 (effective Jan. 1, 2025). Instead, Michigan relies purely on the national NAR settlement's business practice changes, implemented through MLS participation rules — the same approach New York takes. These rules took effect nationally on August 17, 2024, and require any MLS Participant working with a buyer to enter a written buyer agreement before touring a home (in-person or live virtual). Michigan Realtors (the state association) has published updated standard forms (e.g., Exclusive Buyer Agency Contract, Form J/JJ, and a Buyer's Broker Compensation Addendum) to help members comply, but these are association-provided contract templates, not products of new state legislation. Michigan's older occupational code provisions on agency disclosure (MCL 339.2517, MCL 339.2512d, part of 1980 PA 299) require written agency-relationship disclosure before a buyer/seller shares confidential information, but this framework predates the settlement by decades and was not created to implement it. A 2025 bill (HB 5228, tie-barred with HB 5229 and HB 5227) to amend MCL 339.2517 was introduced in the Michigan House but had not been enacted as of mid-2026 — it remains in committee/introduced status, so it cannot be cited as current law. Separately, a group of Michigan brokers filed an antitrust suit against NAR over mandatory membership/MLS access rules (unrelated to buyer-agreement content); that case was dismissed in March 2026 and is now on appeal to the Sixth Circuit, and does not itself impose or codify buyer-agreement requirements.
